AB-5 Is Back
Please review your independent contractors to make sure they pass the ABC test. 1099s will be heavily scrutinized in 2023… a worker is presumed to be an employee, unless the hiring entity can establish that:
A. The worker is free from the control and direction of the hiring entity in connection with the performance of the work
B. The worker performs work that is outside the usual course of the hiring entity’s business.
C. The person is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed.
New rule: Publish your pay rates
SB1162 says starting January 1st, CA employers with 15 or more employees must post pay ranges when hiring for an open position.
New rule: Leave of Absence
AB 1949 requires CA employers with five or more employees to give workers up to five unpaid days of bereavement leave.
$15.50 Minimum Wage
As of January 1, 2023, the state-wide California minimum wage will rise to $15.50/hour for all employers. Some cities like Los Angeles and San Francisco have higher minimum wage rules – email me for a complete list. Heartland Payroll+
