Starting 1/1/2022, employers will face “Criminal Charges” (according to AB1003), when they intentionally deprive their employees of wages, benefits, gratuities or any other compensation due. This “Grand Theft” may be punishable by imprisonment for up to 3 years! More specifically, if within a consecutive 12-month period, the theft is $950 for one employee, or $2,350 total from at least two employees, then these criminal charges along with fines may occur.
Let’s make sure you pay your employees and independent contractors correctly. There is no such thing as an honest mistake when it comes to wage and hour, and according to AB1003.
